Definitions
For the purposes of this agreement,

  • Consumer is defined as the person liable for amounts to be paid per this contract for the period defined in section 2.1 below.
  • Student is defined as the learner who is registered for tuition at Innovatus Pinetown City Campus (“Innovatus”) per this contract for the period defined in section 2.1 below.
  • The Student and Consumer can be the same individual, however, where the Student is also the Consumer, and notwithstanding the terms and conditions set out in this contract, the guarantor or parent is still fully liable for all unpaid amounts still to be paid to Innovatus per this contract and for the period defined in section 2.1 below.

Contractual period of this agreement

  • A registration by a Student shall be for the entire period/duration of the qualification registered for. This period/duration of registration is explicitly defined as follows:
  • Students registering at a Nated N4 level (N4, N5 and N6 Theory): 6 months per level, totaling an 18-month period/duration.
  • Students registering at a Nated N5 level (N5 and N6 Theory): 6 months per level, totaling a 12-month period/duration.
  • Students registering at a Nated N6 level (N6 Theory): 6 months per level, totaling a 6-month period/duration.
  • All Institute of Certified Bookkeepers courses (“ICB”): 12 Months per qualification, totaling a 12-month period/duration
  • Students registering at a NCV 2 level (NCV 2, NCV 3 and NCV 4 Theory): 12 Months per level totaling a 36-month period/duration
  • Students registering at a NCV 3 level (NCV 3 and NCV 4 Theory): 12 Months per level totaling a 24-month period/duration
  • Students registering at a NCV 4 level (NCV 4 Theory): 12 Months per level totaling a 12-month period/duration
  • Students registering at a ETDP Level 4 (Level 4, Level 5 and Diploma): 12 Months per level totaling a 36-month period/duration
  • Students registering at a ETDP Level 5 (Level 5 and Diploma): 12 Months per level totaling a 24-month period/duration
  • Students registering at a ETDP Level 5 Diploma (Diploma): 12 Months per level totaling a 12-month period/duration

The above durations are subject to change by action of the Board of Trustees.

Cancellation

If the Student registered in an academic year wishes to cancel their enrolment for that year, the following conditions shall apply:

Student may cancel his/her enrolment for the current academic year of study as a whole during the respective academic year, however the Consumer shall be liable to pay the reasonable cancellation costs that Innovatus has determined to be reasonable, which is equal to 2 (two) monthly instalments plus any amount(s) in arrears applicable to the course registered for and respective Consumer debtor account balance. However, at the discretion of Innovatus and subject to the parties reaching agreement on the relevant terms and conditions, the Consumer debtor account and course registration may be deferred to a course within the same academic year, to the same Student at the election of the Consumer or Student.

 Transfer from one Innovatus Campus to another

  • All tuition will be conducted at the preferred campus indicated on the face of this agreement, unless Innovatus informs the Student otherwise.
  • A full ‘Transfer Policy’ document will be made available to the Student if requested and forms part of this contract of enrolment. This means that a Student is entitled under certain circumstances and subject to the terms of the transfer policy to receive tuition from an Innovatus Campus at a different location.

Change of course registration

  • A Student who wishes to transfer his/her enrolment from one Innovatus academic programme to another, at the same campus and in the same academic year, may apply for permission to do so from Innovatus. Where the fees in respect of the programmes differ, the transfer shall be subject to a new credit application by the Consumer and Innovatus’ approval of the credit application and the transfer. In all such cases, the fee payable will be that of the programme carrying the higher fee, even if that happens to be the programme from which he/she is transferring. In addition to the higher tuition fee, the Consumer will be charged the value of the notes/books for the programme from which he/she is transferring, as well as those required for the programme to which he/she or the Student is transferring to. In the case of a Student transferring from any full-time computer programme to another, the Consumer will additionally be charged a default administration fee in respect of computer and software costs.

Deferral of Programmes

All Students wishing to defer their studies, or part thereof, may make an application in writing to Innovatus within 14 (fourteen) days of the start of the course whereupon flexible study options may be considered at the sole discretion of Innovatus. A deferral charge of 30% (thirty percent) of the original cost of the programme to be deferred will be levied against the Consumer as a precondition to Innovatus approving the application for the deferral. A full ‘Deferral Policy’ Document will be made available to the Student and is also available at all Innovatus campuses and forms part of this contract of enrolment.

General

  • The Student, Consumer, Parent and Guarantor shall not, by reason of the Students failure to attend lectures, be entitled to a reduction in fees, nor will it absolve the Consumer, Parent or Guarantor from full liability for the payment of the full fees and other charges. Once a Student has signed this agreement, the Student may not cancel this agreement except as provided for herein.
  • Full fees are payable should any payment per the agreed payment plan be missed and the Student and/or the person responsible for payment hereby agree and acknowledge that such Student will be barred from attending campus or receiving any tuition material or tuition or sitting/attending exams or receiving results or receiving final certificates until satisfactory arrangements have been made with Innovatus and are acceptable to Innovatus. Innovatus reserves the right to exclude a Student more than once from its campus.
  • The Student debtor account must be at a nil outstanding balance in order for the Student to be allowed to sit for examinations/attend and write the examinations. Further to this, the Student debtor account must be at a nil outstanding balance for the Student to receive his/her examinations results and certificates. If it is agreed by Innovatus that the Student may sit for an examination without a nil balance debtor account, the results from the examinations and certificates will not be distributed to the Student until such time the debtor account is settled in full and reflects a nil balance owing to Innovatus.
  • No consensual or other cancellation of this contract shall be of any force or effect without written consent thereto by an authorised director or authorised official of Innovatus. The Consumer and Student is hereby informed that no verbal agreements by any person shall be of force and effect unless the Consumer or Student has such cancellation confirmed in writing from the Innovatus Cancellation Committee. The Student and Consumer by his/her signature hereto is made aware of the provisions of this clause and hereby acknowledges acceptance thereof. Refunds will take a minimum of 90 (ninety) days to be paid from date of approval by the cancellation committee. Any amounts to be refunded will be firstly subjected to clause 3.2. By his/her signature hereto, the persons responsible or standing surety to the payment of fees and/or any amounts due under and/or in terms hereof hereby irrevocably authorises Innovatus to perform such credit checks as it may in its sole discretion determine with any recognised credit bureau or the like.
  • The right to attend lectures and write exams is not transferable. Accordingly, the Student shall attend all lectures in person and shall be the only person entitled to write examinations in respect of the subjects forming part of the Innovatus programme for which the Student has registered.
  • All fees and monthly instalments are payable in advance. Interest will be charged on all overdue accounts as from the date on which such amounts are or become due at the rate of 15% (fifteen percent) per annum from which the date the Consumer acknowledges to be liable to pay interest from date of default until date of final payment.
  • The Student accepts that Innovatus shall have the right to vary the programme syllabus at any time, without prior notification and without furnishing the reasons thereof. Innovatus shall further have the right to alter timetables and programme commencement dates at its own discretion. The Consumer and Student hereby acknowledges and accepts that Innovatus shall have the right at all times to vary the terms and conditions hereof. Innovatus Pinetown City Campus shall post such alterations and/or additions and/or variations on its website (www.innovatus.co.za) as soon as is practical in the circumstances and the Students attention is drawn to the provisions hereof and the Consumer and Student undertakes to visit such website regularly to ensure that the Consumer and Student is fully informed of such.
  • Innovatus shall have the right in its sole discretion, to postpone or cancel tuition in any programme initially advertised and offered, on the basis of insufficient demand. Innovatus shall be entitled to combine classes of a similar academic level and content.
  • Innovatus will be entitled to create and apply rules (including due performance requirements) and the Student hereby agrees to be bound by such rules. Innovatus shall be entitled to exclude the Student from lectures and examinations (without in any way detracting from the right of Innovatus to recover the full fees payable per this contract), and to withhold a Student’s test and examination results should the Student or the Consumer fail to comply with any such rules or terms of this agreement.
  • The Consumer shall be liable for all costs incurred by Innovatus, including but not limited to attorney and client fees, collection charges and tracing charges in enforcing the obligations of the Student, Consumer, Parent and Guarantor under this agreement, to the maximum extent permitted by the National Credit Regulator.
  • The fees and other charges reflected on the invoice do not include external institute membership fees, external university fees, examination fees, notes, books, stationery or other items, which shall be for the account of the Consumer/Student.
  • The Student is responsible for ensuring that he/she has been properly registered with any relevant examining body including ensuring the accuracy of all registered particulars.
  • In the case of an extraordinary event or circumstance beyond the control of such parties, such as war, strike, riot, crime, act of God (e.g. earthquake, volcano), Innovatus will be entitled to suspend lectures and temporarily close any campuses affected thereby. The Consumer shall not due to such suspension or closure be entitled to terminate this agreement or claim a refund, fees paid or a reduction on fees payable or any compensation from Innovatus.
  • No relaxation, variation, or indulgence granted by Innovatus to the Student or Consumer shall constitute a waiver of any rights vesting in Innovatus in terms hereof, and no reliance may be placed by the customer or signatory hereto or any statement or representation (whether oral, tactic or otherwise) not contained herein, neither shall such indulgence granted operate as an estoppel against Innovatus.
  • All correspondence must be by way of registered mail, telefax or by hand delivery to Innovatus premises. All correspondence must be received and signed for by Innovatus prior to the applicable cut-off date as stated elsewhere in this agreement. It is the responsibility of the Student or Consumer to ensure that he/she obtains confirmation in writing from Innovatus on receipt of any documentation.
  • In the event of the signatories to this agreement, other than Innovatus, having completed this form incorrectly, or the payment details herein not being in accordance with the requirements of Innovatus, Innovatus shall be entitled to reject the Student’s application or to require the Student to complete a new application.
  • Any Student/Consumer who receives a promotional item as a result of this enrolment contract, hereby acknowledges that Innovatus is not responsible for any repairs, service issues, warranties or performance in relation thereto. These must be referred to the promotional item manufacturer, service provider, network or agent(s) thereof, as the case may be.
  • The Student accepts, as stipulated in the Innovatus Assessment Policy (which shall be deemed to form part of this agreement) that as part of the assessment of the programme, the Student must fulfil certain academic requirements, which may include (but are not limited to) the completion and/or sign-off of a Portfolio of Evidence or other forms of assessments. The Student understands that submission of any academic work should be the intellectual work of the Student. Should submission of any academic work not be that of the Student, it will constitute fraud, which may result in the expulsion of the Student.
  • By their signature hereto the signatory/signatories hereto authorize/s Innovatus to enquire from the employers of the persons responsible for payment and including the Student and/or Surety, the complete details of the salary of such person including the date on which the salary is paid and the amount.
  • Any amounts that are due under and/or in terms of this agreement shall be deducted on the salary date of the person who is responsible for payment. The Consumer hereby duly authorises Innovatus to debit their respective bank account, on more than 1 (one) occasion in a calendar month if necessary, to settle any and all amounts due under this agreement.
  • Should for any reason whatsoever a debit order is returned unpaid then the person responsible for such payment hereby irrevocably authorises Innovatus to debit his/her account with the amount due on any date as Innovatus may choose.
  • If payment fails via Debit order, a R100 administration fee will be charged to your account in addition to the fee charged by the respective bank in respect of such reversal.
  • Tuition and fees are subject to change by action of the Board of Trustees. The amounts payable per this contract are the minimum amounts payable.

Address for receiving of documents

Innovatus and the Student and Consumer choose as their addresses for service of legal documents the addresses listed at the top of this agreement. Any party to this agreement may change its address by delivering to the party a written notice of the new address in the manner specified in the National Credit Act, and any delivery made or attempted at such address chosen by the Student shall be proof of completion of Innovatus’ obligation to ensure appropriate and legal delivery of legal documents to the student, parent and/or guarantor.

Furthermore, delivery by hand at the Innovatus campus in which the student is registered shall be considered an acceptable address for legal documents to be served to the student, parent and/or guarantor.

With regard to any study material or other resources due to the Student, the Student warrants that such address at which delivery of all material and/or study notes etc. is to be effected and indemnifies Innovatus against any claim for non-delivery of Student materials. The onus is on the student to ensure receipt of the study materials due to them in accordance with this agreement.

Legal Declaration and Indemnity

Neither Innovatus nor any official employee or representative of Innovatus acting in his/her capacity as such shall be liable for any damages arising out of:

  • The death, bodily harm, loss of health or illness of any person on college premises
  • The destruction of or damage to any property owned by or in the custody of any person on college premises, howsoever caused
  • The Student and Consumer hereby indemnifies Innovatus against any claim made (whether for damages, costs, or otherwise) against Innovatus in respect of any action and/or omission of the Student and/or the Consumer.
  • The Student by his/her signature hereto hereby confirms that he/she is fully aware of the type of course and/or programme enrolled for and that it is his/her responsibility to make himself/herself aware of the types of courses and that he/she has fully understood the course that he/she registers for and it is indeed the course that he/she wants to register for and that no representations have been made other than those contained in the official brochure.

Accompanying Documents

The following material must accompany this application namely:

  • The original and certified Copy of the front page of the Student’s valid identity book (if a South African citizen);
  • The original and certified Copy of the front page of the Consumers valid identity book (if a South African citizen);
  • Certified copies of Student’s study permit and front page of valid passport (if not a South African citizen);
  • Where applicable, original and certified copies of Matriculation (Grade 12) Certificate, or symbols, or School Leaver’s Certificate. If the Student is awaiting matriculation result, these must be furnished as soon as they become available;
  • Original and certified copies of Academic record and certificate of good conduct should the Student be transferring from another tertiary education institution or examining body to Innovatus;
  • If a payment option other than cash is selected, the Student/company/guarantor/surety/consumer must submit:
    • Proof of income, being in respect of permanently employed persons.
    • The original and certified copies of the 3 (three) most recent salary advices or 3 (three) months’ bank statements for self-employed persons.
    • Proof of residence of account payer.

Rules and Regulations

The Student by his/her signature hereto, hereby agrees to abide by all the rules and regulations of any Innovatus that he/she attends and acknowledges that he/she can be disciplined in terms thereof. The Student further acknowledges that right of admission to any of Innovatus campus is strictly reserved and Innovatus may at its own discretion refuse admittance to any Student.

 Entire Contract

The terms and conditions contained herein superseded by only the terms and conditions contained on the Innovatus website (www.innovatus.co.za) shall be the entire contract between the Student/Consumer and no alteration and/or any verbal representation and/or variation or amendment will be of any force and effect unless such is reduced to in writing and signed by all parties hereto.

I, the undersigned Student/Consumer/Parent/Guarantor hereby do confirm that the following points listed below (where applicable to me), have been brought to my attention, and that by my signature herein, I do agree to all stated terms and conditions as applicable to my course.

I confirm that I have been advised of the following:

NATED COMBO DECLARATION:

  1. The admission requirement is a Grade 12 Senior Certificate.
  2. The course is administrated and certified by the Department of Higher Education and Training (“DHET”).
  3. The programme is limited to 18 months of contact study, irrespective if I pass or fail. Therefore based on my performance, I can either complete all 3 levels i.e. N4, N5 and N6, any 2 levels or 1 level within the 18months.
  4. I am required to pass all subjects at all 3 levels at the first examination sitting for each of the levels to complete the programme in 18 months. Should I not pass a certain level e.g. N4, then I will be automatically registered for N4 again in the 2nd semester.
  5. I understand that in the event of me failing a certain level, my course is still limited to 18 months. Should I wish to study for a period longer than the prescribed 18-month period, I will be required to pay an additional fee as applicable.
  6. I understand that I am liable to an exam fee of R100 per subject to be examined.
  7. I acknowledge that this agreement is registration for an 18-month period/duration and that deregistration is subject to the clauses detailed in the terms and conditions of this agreement.

ICB (FASSET) STUDENTS:

  1. The admission requirements are course specific and range from Grade 10 to a Grade 12 Senior Certificate.
  2. The course is administrated and certified by the Institute of Certified Bookkeepers (“ICB”).
  3. The programme registered for is limited to 12 months of contact study to complete the respective qualification, irrespective of the fact that courses can be written beyond 12 months.
  4. I am required to pass all subjects at each examination sitting for each of the subjects to complete the programme in 12 months.
  5. I understand that should I wish to study for a period longer than the prescribed 12-month period, I will be required to pay an additional fee as applicable.
  6. I understand that the ICB course fees do not include ICB specific fees such as Student Registration Fees, Exam Fees, Exam Postponement fees etc. and other ICB fees as may be applicable.
  7. I acknowledge that this agreement is registration for a 12-month period/duration and that deregistration is subject to the clauses detailed in the terms and conditions of this agreement.

SHORT COURSES /QCTO COURSES/ ASMA / ICDL:

  1. I understand that Industry/SETA Qualifications and International Programmes, are independently recognised and are not required in terms of current legislation to be registered with the Department of Higher Education and Training.
  2. I understand that should the course for which I am registered for not have external examinations, I will receive an Innovatus Certificate of Attendance only.

PART-TIME LEARNER REQUIREMENTS:  

  1. Tuition for part-time learners is held on Saturdays. The onus is on the learner to read their coursework and prepare themselves for their exams without the supervision of their Facilitators. By enrolling part-time, the learner confirms that they would take full responsibility of their studies. Saturday classes will be used to draw the Facilitators attention to problem areas as well as a more focused exam preparation.

By reading this document, I hereby declare that I have read and understood the contents of this document. I further understand that should I terminate my enrolment or not attend lectures for whatever reason, I am still liable for the programme fees as stated in the terms and conditions of this contract.
